By participating in Coldwater Collective’s (the “CWC’s”) cold plunging activities (the “Activities”), you acknowledge and agree to the following:

1.     I understand that the Activities involve immersion in cold water, which may present inherent risks including, but not limited to, shock, hypothermia, drowning, and other serious injuries or death. I understand that these risks cannot be completely eliminated, even with the implementation of safety precautions and guidelines.

​

2.     I represent and warrant that I am in good physical condition, and I have no medical conditions or health concerns that would prevent me from safely participating in the Activities. I further understand and acknowledge that the CWC organizers highly recommend that I seek medical advice from a medical professional prior to participating in CWC, to ensure that I am in proper physical condition to participate in the Activities safely.

3.     I agree to abide by all safety guidelines and instructions provided by the CWC, including, but not limited to, guidelines related to entry and exit from the water and recommended immersion times. (See the Safety Guidelines)

4.     I understand that information provided by CWC is for general informational purposes only. Providing this information does not constitute the practice of medicine, nursing or other professional health care services, including the giving of medical advice, and no doctor/patient relationship is formed. The use of information provided by CWC is at the user's own risk. The information provided by CWC is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Users should not disregard or delay in obtaining medical advice for any medical condition they may have and should seek the assistance of their health care professionals for any such conditions.

5.     I agree to indemnify, defend, and hold harmless the CWC, its organizers, volunteers, and sponsors from any and all claims, damages, liabilities, costs, and expenses arising from my participation in the Activities, including, but not limited to, claims for personal injury, property damage, or wrongful death.

6.     I agree not to sue the CWC, its organizers, volunteers, or sponsors for any injuries or damages arising from my participation in the Activities.

​

7.     I waive my right to pursue any legal action against the CWC, its organizers, volunteers, or sponsors, whether in connection with the Activities or otherwise.

​

8.     I acknowledge that this Agreement and Liability Release shall be binding upon my heirs, executors, administrators, and assigns, as well as any legal guardian, representative, or other agent acting on my behalf.

​

9.     I agree that any dispute arising from my participation in the Activities shall be resolved by mediation or, if necessary, binding arbitration in accordance with the laws of the state of Washington.

​

10.  I agree that this Agreement and Liability Release Form shall be governed by and construed in accordance with the laws of the state of Washington. Any legal action related to this Agreement and Liability Release shall be brought in the courts of the state of Washington.

​

11.  I acknowledge that I have read this Agreement and Liability Release Form, understand its terms and conditions, and agree to be bound by them. I recognize that I am encouraged to ask questions about this Agreement and Liability Release if I have them, and all of my questions have been answered to my satisfaction.

​

12.  I acknowledge that the CWC is committed to safety and has taken measures to minimize risks associated with the Activities. However, I understand that it is ultimately my responsibility to assess and manage risks associated with my participation in the Activities.

​

13.  I further grant permission to CWC to use any photographs, motion pictures, recordings, or any other record of these events and activities for any legitimate purpose it sees fit.
